These Terms & Conditions govern your use of RouteOps Pro, an operations management platform for Amazon delivery service partners. The service is provided by Benton Whitt (the “Seller”, “we”, “us”). By creating an account or continuing to use the service, you agree to these terms on behalf of yourself and, where you act for a business, you confirm you have authority to bind that organisation.

1. The service

RouteOps Pro helps delivery service partners manage drivers, vehicles, routes, attendance, safety scorecards, coaching, documents, payroll hours and profitability. We grant you a limited, non-exclusive, non-transferable right to use the service for your own business operations within the plan you select.

We do not guarantee the service will be uninterrupted or error-free, and features may change over time as we improve the product.

2. Acceptable use

You must not misuse the service. That includes: unlawful use; fraud or spam; infringing intellectual property rights; interfering with or probing the security of the service (including introducing malware or scraping); and reverse engineering, reselling or redistributing the service or circumventing its technical limits.

You are responsible for keeping your account credentials confidential and for all activity under your account, and for ensuring the information you provide is accurate and kept up to date.

3. Your content

You retain ownership of the data you upload (driver records, documents, photos, reports). You grant us a limited licence to host and process that content solely to provide the service to you.

4. Intellectual property

We retain all ownership of the service and its intellectual property, including the software, documentation and branding. Nothing in these terms transfers any ownership to you.

5. Payments and subscriptions

Paid plans are billed by subscription. Payment, billing, tax, cancellation and refund mechanics are handled by our reseller Paddle and are governed by Paddle's Buyer Terms: https://www.paddle.com/legal/checkout-buyer-terms. New accounts include a 14-day free trial; when the trial ends, an active paid plan is required to keep using the service.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

6. Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. If access ends, you may request an export of your data within 30 days, after which it may be deleted.

7. Warranties and liability

The service is provided “as is”. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

To the fullest extent permitted by law, we are not liable for indirect, consequential or special damages (including loss of profits, data or goodwill), and our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing in these terms excludes liability that cannot be excluded by law, including for fraud, death or personal injury where required.

8. Governing law

These terms are governed by the laws of the United States and the state where the Seller is established, without regard to conflict-of-laws rules. Disputes will be heard in the courts of that jurisdiction.

9. Changes

We may update these terms from time to time. Continued use of the service after an update takes effect constitutes acceptance of the new terms.
